1- Voluntary Participation:  I acknowledge and state that I have applied to voluntarily participate in the Brazilian Jiu-Jitsu classes being conducted, sponsored and or produced by the Conde Koma Brazilian Jiu-Jitsu Academy ("Academy") at the facilities of the Conde Koma Brazilian Jiu-Jitsu Academy, located at 4260 Cerritos Ave., Los Alamitos, California 90720.  I am fully aware and understand that participating in Brazilian Jiu-Jitsu involves strenuous physical activity and extensive physical contact with other people and the ground, including but not limited to: joint locks, throws, chokes, strikes, ground fighting, and other similar activities.  With full understanding of the risks involved, I am voluntarily and of my own free will participating in the event with full knowledge and understanding of the serious danger and hazards involved. 2- Assumption of Risk: I am aware and understand that Brazilian Jiu-Jitsu is an avoidably dangerous and hazardous activity.  I hereby consent and agree to completely take upon myself all risks and responsibilities in any way associated with this activity including injury or death. 3- Release of Liability:  In consideration of and in return for instruction, services, access to the Academy's facilities, permission to participate in Academy events, and other assistance provided to me by the Academy, its instructors, and other members, I hereby agree that I, my heirs, distributees, guardians, successors in interest, and legal representatives (collectively referred to as "Releasor") will not make a claim or file an action or suit against, sue, attach the property of the Academy or any of its affiliated organizations, any and all manufacturers, distributors, wholesalers, suppliers, retailers, and/or providers equipment.  I hereby release, waive, forever discharge, hold harmless and covenant not to sue the Academy, or any subdivision thereof, its owners, directors, officers, instructors, lessees of premises, managers, employees, agents, promoters, consultants, and members from ALL LIABILITY on account of any injury to me, including but not limited to my death or damage to property, in connection with my participation in Brazilian Jiu-Jitsu. I understand that this release covers liability, claims and actions caused entirely or in part by any acts or failures to act by the Academy, or any subdivision thereof, its owners, directors, officers, instructors, lessees of premises, managers, employees, agents, promoters, consultants, and members including but not limited to negligence, gross negligence, mistake, or failure to supervise. 4- Photographic Release:  I understand that during classes, seminars, and/or events at the Academy, my image may be recorded and subsequently used for marketing and media purposes.  I hereby expressly and irrevocably consent to having my likeness shown, publicized, commented and/or reported on without restriction as to frequency, duration or medium.  I do not expect to receive any compensation and waive any right to compensation that I might otherwise be entitled to as a result thereof. 5- Health Advisory and Condition:  I hereby acknowledge and understand that participation in Brazilian Jiu-Jitsu involves extremely strenuous physical activity and that I have been advised to consult with a physician before commencing and undertaking such activity.  I also understand that Brazilian Jiu-Jitsu involves close physical contact and interaction with other individuals and inherently involves the risk of transmission of communicable diseases including but not limited to: COVID-19, influenza, herpes simplex, staphylococcus aureus, ringworm, impetigo, molluscum contagiosum, and scabies.  I hereby represent that, to the best of my knowledge, I am in good physical health and condition, sufficient to undertake the activities and practices required.    6- Indemnification:  I hereby agree to indemnify, defend and hold harmless Academy, or any subdivision thereof, its owners, directors, officers, instructors, lessees of premises, managers, employees, agents, promoters, consultants, and members from any and all claims, including reasonable attorney's fees and costs, or liability that may be asserted against Academy by any third party as a direct or indirect result of my participation in Brazilian Jiu-Jitsu at the Academy, my use of equipment of the Academy, from my participation in any activity directly or indirectly associated with the Academy, from my use of any Brazilian Jiu-Jitsu techniques learned from the Academy, 7- Knowing and Voluntary Execution:  I have carefully read and reviewed this Release agreement and fully understand the meaning and importance of its contents.  I acknowledge that this Release is a binding contract and recognize that I am forever waiving, among other things, my rights to sue the Academy, or any of its subdivisions thereof, its owners, directors, officers, instructors, lessees of premises, managers, employees, agents, promoters, consultants, and members for injuries, damages or losses that I may incur while participating in Brazilian Jiu-Jitsu.  I also understand that this release binds my heirs, distributees, guardians, successors in interest, and legal representatives, as well as myself.  I further declare and represent that I am signing this agreement out of my own free will and accord.
